Terms & Conditions

Last updated: October 2026

These Terms & Conditions apply to products and services supplied by Art N Cast through artncast.com, including jewellery, custom jewellery, keepsakes, fingerprint jewellery, hand and foot impression products, memorial products, and jewellery repairs.

By placing an order with Art N Cast, you agree to these Terms & Conditions.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law (ACL) or any other law that cannot legally be excluded or limited.

1Products & Handmade Variations

1.1Art N Cast produces handmade and individually customised products. Products may be made from precious metals including gold and silver, chrome cobalt alloy, plaster, and other suitable materials.

1.2Products may be created from fingerprints, hand or foot impressions, photographs, physical moulds, digital scans, 2D or 3D data, measurements, drawings, or other customer-supplied information.

1.3Because products may be individually handmade or based on unique source material, reasonable variations may occur in appearance, colour, texture, finish, dimensions, thickness, and weight.

1.4Product photographs and examples shown on the website are for illustration. The finished product may differ from photographs due to materials, lighting, screen settings, manufacturing processes, and the unique characteristics of each individual product.

1.5Unless expressly stated otherwise, dimensions and weights shown on the website or in quotations are estimates.

2Custom & Personalised Products

2.1Custom and personalised products are made specifically for the customer and may include names, dates, engraving, fingerprints, impressions, photographs, dimensions, designs, or other individual specifications.

2.2Custom products may not be cancelled or returned simply because the customer changes their mind once production has commenced, except where a refund, replacement, or other remedy is required by law.

2.3Art N Cast may decline a custom request where it is technically impractical, unsuitable for manufacture, unsafe, or outside the reasonable capabilities of the requested product.

2.4Changes requested after approval or after production has commenced may result in additional charges.

2.5Art N Cast may provide a digital design, engraving preview, or other approval where appropriate. The customer is responsible for checking spelling, names, dates, measurements, engraving, sizes, and other supplied information before approval.

2.6Art N Cast is not responsible for errors contained in information supplied or approved by the customer, except where liability cannot legally be excluded.

3Customer-Supplied Materials & Impressions

3.1Customers may supply physical impressions, moulds, fingerprints, jewellery, photographs, scans, 3D files, measurements, or other materials for use in producing a product.

3.2The customer is responsible for ensuring that supplied information and materials are accurate, suitable, and sufficient for the requested work.

3.3Where the customer takes their own impression, the customer is responsible for the quality of that impression.

3.4Art N Cast will use reasonable care and skill when handling customer-supplied materials, but cannot guarantee a particular result where the material supplied is unclear, incomplete, damaged, distorted, or otherwise unsuitable.

3.5If additional work or replacement materials are required because customer-supplied material is unsuitable or incorrect information has been provided, additional charges may apply.

3.6Customers should not provide irreplaceable items unless Art N Cast has agreed to accept them.

4Children & Memorial Products

4.1Where an order involves a child’s photograph, impression, scan, or other personal information, the purchaser confirms that they have the necessary authority and consent.

4.2Memorial impressions or materials must be supplied by a person or funeral company authorised to provide them.

4.3The person supplying memorial material confirms that they are authorised to provide it for the requested purpose.

4.4Art N Cast will use such material only as reasonably necessary to produce the agreed product unless otherwise authorised.

5Prices, Quotations & Price Errors

5.1Unless otherwise stated, all prices are in Australian dollars (AUD).

5.2Art N Cast may change prices, product specifications, and availability for future orders.

5.3Website product listings and displayed prices are an invitation for customers to place an order and do not, by themselves, constitute acceptance of an order by Art N Cast.

5.4A customer placing an online order submits an offer to purchase the selected product.

5.5Art N Cast may identify and correct genuine pricing, product-description, availability, or technical errors before accepting an order.

5.6A pricing or product error may result from circumstances including, but not limited to:

  • Website or database malfunction
  • Software, plugin, or integration errors
  • Payment-system or checkout errors
  • Incorrect currency conversion
  • Data-entry or product-configuration errors
  • Automated pricing or discount errors
  • Corrupted or incorrectly displayed website data
  • Unauthorised access, hacking, or cyberattack
  • Other technical or system failures

5.7Where a genuine error has resulted in an incorrect price, product description, or other material order information being displayed, Art N Cast may decline or cancel the affected order before acceptance, subject to applicable law.

5.8If payment has already been received for an order that is not accepted because of a genuine error, Art N Cast will refund the amount paid for that order.

5.9Art N Cast may temporarily suspend or remove an affected product from sale while investigating and correcting a suspected pricing, technical, or system error.

5.10Art N Cast will not use this provision simply to cancel an accepted order because it later wishes to charge a higher price.

5.11Nothing in this section limits any rights arising under applicable pricing laws or the Australian Consumer Law.

Custom Quotations

5.12Custom quotations may specify the product, design, materials, estimated precious-metal requirements, price, and quotation expiry date.

5.13Unless otherwise stated, quotations are valid only for the period specified and may be revised after expiry.

5.14Once a quotation has been accepted and any required deposit has been received, the quoted price will generally apply to the agreed work.

5.15Additional charges may apply where the customer changes the design or specifications, requests additional work, supplies unsuitable materials, or otherwise requires work outside the original quotation.

5.16Where precious-metal usage is estimated, the quotation may state that the final price is subject to the actual material requirements.

6Orders, Acceptance & Quantity Limits

6.1Orders are subject to product availability, material availability, production capacity, pricing accuracy, system integrity, and acceptance by Art N Cast.

6.2An automated order confirmation or payment receipt confirms that an order or payment has been received. It does not necessarily constitute acceptance of the order.

6.3Art N Cast may review an order before accepting it.

6.4Before acceptance, Art N Cast may decline or cancel an order where reasonably necessary, including where:

  • The displayed price is incorrect
  • There is a material product or description error
  • Required materials are unavailable
  • The requested product cannot reasonably be manufactured
  • Requested customisation is technically impractical
  • There is a significant website, database, software, plugin, payment, or system error
  • The website or ordering system appears to have been compromised
  • There is an automated pricing, discount, currency, or configuration error
  • Information supplied by the customer is materially incorrect or incomplete
  • Payment cannot be processed
  • There are reasonable concerns regarding fraud or misuse

6.5Where an order appears to have been generated or materially affected by a technical malfunction, unauthorised access, automated system error, or other system failure, Art N Cast may temporarily suspend processing while the circumstances are investigated.

Reasonable Quantity Limits

6.6Art N Cast may apply reasonable quantity limits to products, particularly where products are custom-made, made-to-order, contain precious metals, require limited materials, or involve substantial production capacity.

6.7Where an order involves an unusually large quantity of a product, Art N Cast may contact the customer to confirm the order, verify the intended quantity, or discuss production requirements before acceptance.

6.8A quantity limit may also be applied where an unusually large order appears to have resulted from a pricing error, website or database malfunction, software or plugin error, automated pricing or discount error, unauthorised access, or other technical issue.

6.9Any cancellation, refusal to supply, or limitation of an affected order will remain subject to applicable law, including the Australian Consumer Law.

6.10If payment has already been received and Art N Cast declines the order before acceptance, the amount paid will generally be refunded.

6.11Once an order has been accepted, the order, applicable quotation, and these Terms form the basis of the agreement between Art N Cast and the customer, subject to rights provided by law.

6.12Art N Cast will not rely on this section simply to cancel an accepted order because it later wishes to charge a higher price.

6.13Nothing in this section excludes, restricts, or modifies rights that cannot legally be excluded, restricted, or modified.

7Deposits, Cancellations & Changes

7.1A deposit may be required before custom work begins.

7.2If a customer cancels custom work, Art N Cast may retain or deduct reasonable amounts representing costs already incurred or costs that cannot reasonably be recovered, to the extent permitted by law.

7.3Art N Cast does not automatically treat every deposit as non-refundable regardless of the circumstances.

7.4Where a customer requests changes after work has commenced, additional costs may apply.

7.5Where a refund is required by law, the legally required refund or other remedy will be provided.

8Returns & Change of Mind

8.1For standard, non-custom products, Art N Cast may offer a voluntary 14-day change-of-mind return period from delivery.

8.2Change-of-mind returns must generally be unused, undamaged, and in substantially original condition.

8.3Customers should contact Art N Cast before returning an item.

8.4Unless otherwise agreed, the customer is responsible for return postage for change-of-mind returns.

8.5Customised, personalised, and made-to-order products are generally excluded from voluntary change-of-mind returns once production has commenced.

8.6Nothing in this section affects rights available under the Australian Consumer Law.

9Australian Consumer Law & Warranty

9.1Art N Cast acknowledges that customers have rights and remedies under the Australian Consumer Law.

9.2These statutory rights are not replaced or limited by any voluntary warranty offered by Art N Cast.

Voluntary Six-Month Warranty

9.3In addition to statutory rights, Art N Cast may provide a six-month voluntary warranty against manufacturing or workmanship defects in Art N Cast products.

9.4The voluntary warranty applies to defects arising under normal use during the warranty period.

9.5To the extent permitted by law, the voluntary warranty does not cover:

  • Accidental damage
  • Misuse or neglect
  • Loss or theft
  • Unauthorised alterations or repairs
  • Normal wear and tear
  • Scratches and surface wear
  • Damage caused by chemicals or unsuitable substances
  • Damage caused by impact or improper handling

9.6Art N Cast may inspect a product before determining whether an issue is covered by the voluntary warranty.

10Jewellery Repairs

10.1Art N Cast may provide jewellery repairs, including laser welding and related work.

10.2Jewellery may contain hidden weaknesses, previous damage, fatigue, porosity, contamination, or unsuitable materials that are not visible before repair.

10.3Art N Cast will use reasonable care and skill when carrying out repairs.

10.4If additional damage or work is identified, Art N Cast may contact the customer before proceeding where reasonably practicable.

10.5Repair work may be covered by a voluntary three-month repair warranty, applying only to the repair work performed.

10.6The repair warranty does not cover unrelated components, pre-existing defects, normal wear, accidental damage, or subsequent damage, to the extent permitted by law.

10.7Nothing in this section limits rights that cannot legally be excluded.

11Production Times & Delays

11.1Production times vary depending on the product, design, materials, workload, and other circumstances.

11.2Unless expressly agreed in writing, production time frames are estimates only and do not constitute guaranteed completion dates.

11.3Production time does not necessarily include postage or delivery time.

11.4An express or priority production fee may be available for selected orders. Payment of an express fee does not guarantee a particular completion or delivery date unless expressly agreed.

11.5Delays caused by the customer, including delays in providing approvals, measurements, impressions, photographs, files, payment, or other required information, may extend the production time frame.

12Delivery

12.1Art N Cast currently supplies products within Australia unless otherwise agreed.

12.2Customers are responsible for providing a complete and accurate delivery address.

12.3Delivery times depend on the selected carrier and shipping method.

12.4Art N Cast is not responsible for carrier delays or other delivery problems outside its reasonable control, but will reasonably assist with delivery inquiries where appropriate.

12.5Additional delivery charges may apply where an incorrect address results in redelivery, return, or additional carrier charges.

12.6Nothing in this section excludes any rights or remedies required by law.

13Customer Property & Risk

13.1Art N Cast will take reasonable care of customer property while it is in Art N Cast’s possession.

13.2Customers should not provide irreplaceable or unusually valuable property unless Art N Cast has specifically agreed to accept it.

13.3Art N Cast is not responsible for deterioration, fragility, or pre-existing defects inherent in customer property where reasonable care has been taken, except where liability cannot legally be excluded.

13.4Ownership of a finished product passes to the customer once full payment has been received, unless otherwise required by law.

13.5Risk in products passes in accordance with applicable law.

14Intellectual Property & Customer Material

14.1Art N Cast retains intellectual property rights in its original designs, artwork, photographs, templates, website content, branding, and other original materials.

14.2Customers retain ownership of intellectual property and personal material they provide to Art N Cast.

14.3The customer grants Art N Cast permission to use supplied material to the extent reasonably necessary to process, manufacture, and fulfil the customer’s order.

15Photographs, Reviews & Marketing

15.1Art N Cast may photograph products for internal records, quality control, and order documentation.

15.2Public use of photographs of a customer’s finished product for marketing purposes will be subject to any separate consent provided by the customer.

15.3Marketing consent is separate from acceptance of these Terms.

15.4Customers may be invited to provide reviews or testimonials. Any submitted review should be genuine and not knowingly misleading or unlawful.

15.5Marketing communications will be handled in accordance with applicable Australian law. Customers may unsubscribe from marketing communications where an unsubscribe mechanism is provided.

16Website & Third-Party Services

16.1Art N Cast aims to keep website information, product descriptions, prices, and availability accurate, but errors may occasionally occur.

16.2Art N Cast may correct website errors and update product information for future orders.

16.3Art N Cast may use third-party payment, delivery, hosting, software, or other service providers.

16.4Art N Cast is not responsible for third-party services or websites outside its reasonable control.

16.5Customers must not misuse the website, attempt unauthorised access, introduce malicious software, or use the website for fraudulent purposes.

17Website Security & Your Responsibilities

17.1Art N Cast takes reasonable steps to keep this website and customer information secure, including using secure (HTTPS) connections, reputable payment providers, and regular software updates and backups.

17.2No website, device, or internet connection can be guaranteed to be completely secure or free from viruses, malware, or unauthorised access. Customers use the website at their own risk, to the extent permitted by law.

17.3Customers are responsible for taking reasonable care to protect their own devices and accounts, including by:

  • Keeping their device, browser, and software up to date
  • Using up-to-date antivirus or security software
  • Using a strong, unique password and keeping it confidential
  • Logging out of their account when using a shared or public device

17.4Customers should be cautious of emails, messages, calls, or websites claiming to be from Art N Cast. Art N Cast will never ask for a customer’s account password, or for full card details by email or message.

17.5Customers should contact Art N Cast promptly if they believe their account or information has been compromised, or if they receive a suspicious message that appears to come from Art N Cast.

17.6To the maximum extent permitted by law, Art N Cast is not responsible for loss or damage caused by viruses, malware, or other harmful material that may affect a customer’s device or data as a result of using the website, or for unauthorised access to a customer’s account that results from the customer’s own failure to keep their password or device secure.

17.7Where personal information is affected by a data breach, Art N Cast will respond in accordance with applicable Australian privacy laws, including notifying affected customers and the relevant authorities where required.

17.8Nothing in this section excludes, restricts, or modifies rights that cannot legally be excluded, restricted, or modified.

18Liability & Events Outside Control

18.1Art N Cast will exercise reasonable care and skill in providing its products and services.

18.2To the maximum extent permitted by law, Art N Cast is not responsible for loss or damage arising from circumstances outside its reasonable control, including:

  • Other events beyond reasonable control

18.3Art N Cast is not responsible for loss arising from inaccurate information, measurements, files, or materials supplied by the customer, except where liability cannot legally be excluded.

18.4Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.

19Privacy, Governing Law & Contact

19.1Personal information will be handled in accordance with Art N Cast’s Privacy Policy and applicable privacy laws.

19.2These Terms are governed by the laws of New South Wales, Australia, subject to any mandatory rights or jurisdiction provided by law.

19.3If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

19.4Art N Cast may update these Terms for future orders. The Terms applying to an already accepted order will not be changed retrospectively in a manner that removes rights or obligations already applicable to that order, except where legally permitted.
